Terms of service
By registering for programs with Union Square Play, I agree to follow all terms and conditions of the company.
Waiver and Release of Claims.
COVID & GENERAL LIABILITY WAIVER:
By signing up for and attending class, I release Union Square Play from any liability as a result of attending a class. This includes as it relates to COVID-19.
I further acknowledge that Union Square Play has put in place preventative measures to reduce the spread of COVID-19 and other common viruses.
By entering the space, all children and accompanying adults agree that they will not attend Union Square Play if they are showing signs of illness, including runny nose, cough, sore throat, shortness of breath, fever, loss of smell or taste, vomiting, diarrhea, or chills. We ask that you stay home if you are sick.
I further acknowledge that Union Square Play can not guarantee that I myself or my child(ren) will not become infected with COVID-19. I understand that the risk of becoming exposed to and/or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff and other clients and their families.
I voluntarily seek services provided by Union Square Play and acknowledge that I am increasing my risk of exposure to COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my class.
I attest that:
* I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
In consideration for use of the programming, I, on behalf of myself and my children, waive and release GRRLL, LLC, dba Union Square Play, (“USP”) its agents, subsidiaries, servants, employees, insurers, successors and assigns from all claims, demands, causes of action, damages or suits at law and equity of whatsoever kind, including but not limited to claims for personal injury, property damage, medical expenses, loss of services, on account of or in any way related to or growing out of my presence at an event or use of the facility and/or equipment. I hereby acknowledge and agree that I understand and fully appreciate the risk of injury involved to one participating in USP activities and services. This waiver and release is intended to and does release USP from any and all liability for damages or injuries on account of or in any way related to or growing out of my negligence, the negligence of third parties, and USP’s negligence, including but not limited to negligence in the construction, maintenance, and upkeep of a facility and its equipment, negligence in training or negligence in supervision. This is not intended to release USP from any liability resulting from their intentional conduct. I covenant and agree not to institute any claims or legal action against USP for any claim released by this Agreement. I further agree that should any claim be made against USP in contravention of this Agreement, including but not limited to derivative claims, I will protect, defend and completely indemnify USP for any such claim and expenses including attorney’s fees and costs incurred by USP in defending itself hereunder.
Acknowledgements. I recognize the events are not supervised, and I use the facility (including premises and equipment) entirely at my own risk. I understand that USP is not responsible for any lost or stolen valuables or property while at the event. While at the event, I agree to conduct myself in a responsible manner and will refrain from engaging in inappropriate conduct, including the use of loud, foul, slanderous language or any intimidating or offensive conduct that would interfere with the peaceful use and enjoyment of the event by other users. I agree that I will fully comply with all rules and regulations and with any amendments. I understand that my email address may be shared with Union Square Play affiliates, partners, or providers.
Health and Safety. I register understanding the risks and benefits of physical activity and state that all family members participating are in condition to play. USP does not have medical staff available and cannot provide emergency or other medical treatment.
Cancellation. If you are not satisfied for any reason, please let us know at support@unionsquareplay.com. We exist to help make your life easier, and we’d like another opportunity to do that.
For classes: you can cancel them anytime before the start of the class. You can cancel within your account with the click of a button, and we will issue credit in the form of USP Account Credit* equal to the purchase price. You can then redeem the credit for a new class of your choice. *NOTE it may take up to five (5) business days for your credit to be issued.
All class referral credit is valid up to ten (10) referrals. Credit received for referrals beyond 10 class credits will be invalidated.
For retail returns, please check with us, as the policy is vendor-specific.
*USP Account Credit does not carry any cash value and expires after six (6) months from the date issued.
Affirmation. I have read the Terms and Conditions and affirm that by registering for programs at USP I consent to be bound by its terms, including the waiver/release of any legal right I may have against USP for any costs incurred due to a claim or legal action brought in violation of these Terms and Conditions. I acknowledge that violation of the Terms and Conditions, as determined by USP, may result in my removal from the event.
USP has the right to update these Terms and Conditions at any time. Classes, operating hours, class times, and staff are subject to change without notice.
Mobile Terms of Service

The Union Square Play mobile message service (the "Service") is operated by GRRLL LLC dba Union Square Play (“Union Square Play”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Union Square Play’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Union Square Play through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Union Square Play. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18339751378 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Union Square Play mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

How do you treat children’s privacy?
USP’s online services are not exclusively directed to children under the age of 13 and are not intended to be used without a parent, guardian, or supervising adult present. In addition, you are not permitted to use USP’s online services if you do not meet the minimum age requirement applicable to our online services in your jurisdiction. We do not knowingly collect personal information from children under the age of 13. If you learn that your child has provided us with personal information without your consent, you may alert us at info@unionsquareplay.com. If we learn that we have collected personal information of a child under the age of 13 (or under the age of 16 in certain jurisdictions, such as EU member countries) we will take steps to delete such information from our files as soon as possible and terminate the child’s account unless we receive verifiable parental consent.
